Misdemeanor charges, though not as severe as felonies, are still something that can permanently tarnish a person’s criminal record, no matter how small or petty the charges may be. It is usually defined as a crime that is punishable by a maximum of one year in a county jail plus a maximum fine of $1000, unless the specific misdemeanor crime that was committed has a different jail time and fine stated. Offenses that fall under the misdemeanor category in the State of California may include, but are not limited to driving under the influence, driving on a suspended license, battery, disturbing the peace, petty theft, public drunkenness, trespassing, brandishing a weapon, and assault.
On top of the fines and jail time, however, misdemeanor charges are also usually followed by up to a year of probation, house arrest, restitution for the victim, or counseling and community service, all of which will be noted in a person’s permanent records.
We at Blomberg, Benson & Garrett, Inc. understand how such records can potentially affect a person’s future and opportunities, especially if the offense was particularly minor.
